Terms of Service

(Friday-Sunday are break weekends. Commissions will not be worked on at this time, subject to change.)Rules:
- Payment is in Paypal. (USD)
- I will not start the commission until I receive full payment.
- Payment will be sent via "Goods and Services" for commissions, adopts, etc.
- Please provide a clear and neat visual reference of your character.
-I have the right to deny a commission I don't want to do.Reposting:
- You are fine to repost a commission I make for you on other sites (Tumblr, Instagram, ect), just please link my page and the original post! (Example: This work was made by eyesorefortheblind.deviantart.… and can be found here: (Insert link to original post).
- Do not claim as your own work when you repost it.
- You will receive an unwatermarked and watermarked version of the artwork. Please only repost the watermarked version when posting to other sites to reduce the chance of theft and increase the chance of discovery if stolen.- Only the owner of the character(s)/commissioner is allowed to repost the artwork, unless stated otherwise.

Commission Process + Refunds

Commission Process:
The work must be paid for in full before I can start any form of work on your commission.Each stage of the commission process (where applicable), you will be given a WIP image for approval.
- Example: I will send you a completed sketch to assure everything is okay before I start color line and color (if there is color).Changes will be made where requested and shown for approval before moving on to the next stage.
- Changes requiring a rework of a large portion of the image, drastic pose redraw, or major change may cost you more.Refunds:
I can give refunds but you will only receive a refund equal to the amount of work I have not done.
- Example) If I start the sketch, I will return your money minus the price of the sketch and you will receive the sketch.

Copyright/Usage

As the artist, I own the right to the produced drawing.
This does not mean I will make claim to your character.This means I hold the right to:
- Use the image for promotional reasons (commission examples, etc)
- Display the final image in my art galleries/websites.**The commissioner may: **
- Use the image for personal use.
- Claim the rights of their character(s) but not the drawing itself.
- Use the art to promote themselves with proper credit given to me as the artist of the piece.
- Make prints for personal, non commercial use.The following is considered copyright infringement and NOT allowed:
- Reproducing/using the copyrighted material commercially (making money off the piece in any way.)
- Taking credit for the creation of the artwork.
- Removing my artwork/signatures.
- Altering the artwork without my, the artist's, consent.AI/NFTs
Regardless of purchase of commercial rights, the commissioner may NOT use any paid for works for any form of NFT/AI purposes.

Purchase of Commercial Rights

A Purchase of Commercial Rights to the artwork will cost 300% of the original price. This cost will not be influenced by the circumstance that commission prices are changed during the commission process.With commercial rights you are allowed to:
- Make any sort of merchandise (prints, buttons, pins, shirts, etc) with the artwork.
- Use in books, propers, covers.
- Change the image to your liking.With commercial rights you are NOT allowed to:
- Use for NFTs (Non-fungible tokens).
- Any form of AI generated works.Credit is still required for usage of the artwork, even if altered or edited

Will/Won't Draw

**Will Draw: **
- MLP OCs/Canon Characters
- Pokemon OCs/Canon Characters
- Artistic Gore
- Candy/Pastel Gore
- Anthro/Furries/Scalies
- Humans (Not the best but I can try)
- SFW Shipping Images. (IncludesOC/Canon, OC/OC, Canon/Canon)
- NSFW/18+ works (Only provided to a purchaser ages 18 and up)
If requesting 18+/NSFW artworks with an Original Character owned by another person, the second party MUST a) be 18 years old or above AND b) their character must be 18 years old or above AND c) provide consent from the owner of the character to have their character drawn in requested situation.**Will NOT Draw: **
- Heavy Mechanics/Robots
- Illegal acts (rape, pedophillia, incest, etc)
- Fetishes (Vore, Foot, Inflation, Diaper, Scat, ect)
- Racist, sexist, transphobic, homophobic topics.
- Gore for the intent of retaliation, revenge, or ill intent to another person.
- 18+/NSFW artworkds for the intent of retaliation, revenge, or ill intent to another person (ie - revenge porn, rape art, etc).

Black List Information

Black List:
You will be blacklisted from art, adopts, etc from me if:
- You fail to pay within a reasonable amount of time. (One week or otherwise stated.)
- You are blocked by me (automatic blacklisting).
- You request a stolen character to be drawn.
- You recolor/edit my art without permission.
- You claim my or others' artwork as your own.
- You bother/harass me/others for free art/closed trades/closed commissions.
- You are a known harasser/scammer/thief, etc.
- You use my artwork for AI/NFT purposes.

Please Note:

- I retain the right to deny any commission for any reason. Common reasons commissions may be declined; difficulty of design, no time available for commissions at the current moment, or listed in the "Will Not Draw" section.
- Prices are subject to change. If prices are changed during the commission process, you will not be charged extra.
- Complicated characters may be charged extra based on design.
- If I am unable to finish your commission for any reason, a refund equal to the amount of work not finished and the work up to that point will be given to the commissioner.

Edits to a commission

- Small edits can be made with no issue! Color changes, simple marking edits, etc. Small edits can b made after the commission is complete only if they were missed during the commission process.
- Large changes during the commission process may cost you more (ex - outfit changes/additions, background edits, entire redraws)
- Please assure your reference is CLEAR. Unclear references that lead to a certain degree of changes that could have been avoided with a clear reference sheet will cost more.
- If your reference is not clear, that please detail what needs to be followed in your commission order form.

Agreement to the Terms of Service

Commissions of any form must include an agreement to the above terms of service. In order to satisfy this requirement, a completed agreement of the terms must be included upon payment. This can be done in Direct Messages or the Paypal notes of the commission payment."I, (username or legal name here), hereby agree to the terms and conditions set by EyesoreForTheBlind on (today's date). I have read the linked page and its rules and agree to the terms and conditions set.
Terms of Service:
I understand that if I break these terms, I hereby relinquish the privilege to commission this artist in the future, as well as possibly be partially or fully refunded depending on the stage of the commission process and the severity of the terms broken."
